RENTAL CONTRACT FOR MOTORHOMES.

1.- The hirer is interested in proceeding his renting following the terms in this document. He assures is over 25 years of age and hold a driver’s license class B for more than 2 years. The hirer hires to the owner the vehicle described in this document during the period stated in the same. The hirer allows in the moment of delivery the owner to change the vehicle described for another one of the same characteristics or superior. In that case: the delivery to the hirer of the supplements detailed and required is limited to availability at the moment of delivery of the vehicle. If the owner did not have them, he would have to return the corresponding amount deposited by the hirer as a reservation. The supplements are the followings: Bicycle track, Colour T.V.. The hirer must specially look after the hired goods(in this case the hired good) and drive it with the greatest diligence and care, responding of any deterioration cause by any defective, negligent o reckless driving .The hirer will compensate the owner of any damage in the goods hired no matter what the damage is. The hirer must check regularly the oil levels and gear box , cooling liquid and so corresponding to the vehicle, responding this way to the right maintenance of the vehicle while having possession of the same.

2.- a/ Until the hirer does not return the motorhome to the owner’s legal representative in the placed agreed, the hirer keeps maintaining the possession of the same, in consequence , he will keep being responsible for its preservation, care, maintenance, plus the payment marked down as a daily indemnification and without prejudice of the others which correspond as an indemnification of the damages and prejudices;

b/ Any delay in the drop off superior to 12 hours of the marked down time will follow an indemnification in favour of the owner of 700€ plus tax. Any delay superior to 24 hours will follow an addition of 235€ daily plus tax in favour of the owner. These indemnifications are fixed to compensate the use of the motorhome , but the hirer will also have to indemnify the owner of any other prejudice as for example, the amount that this society will have to satisfy to the damage cause to third parties having rented a motorhome and not being able to receive a vehicle because of the delay described above, being or not the hirer’s fault ;

c/ The motorhome will be returned in the same conditions it was handed over. The vehicle will have to be clean on the inside as well as on the outside, and the residual deposits will have to be emptied. Otherwise the client will be charged for185€ plus tax if the cleaning had not been completed;

d/ When returning the vehicle a conformity will be issued to assure that the vehicle has been returned in the right conditions. If the hirer hasn’t got this conformity the owner will esteem disconformities ;

e/ The lack of delivering the vehicle on time will carry the consequences mentioned above and all the payments for the damages and prejudices will be charged to the hirer for the delay;

f/ If the hirer was behind time in receiving the motorhome or if he decided to return it before schedule time, nothing will be returned to him;

g/ In case of braking down with the vehicle and having to suspend the renting no amount would be returned either.

3.- To guarantee the reservation, the client must pay 35% of the total amount of the rental of the motorhome , having to pay the rest on departure’s day. The lack of paying the rest of the money by the hirer will mean the loss of the money given to the date. The hirer will be able to cancel this contract before receiving the motorhome.

4.- The guarantee of your responsibilities fulfilment , and without prejudice of your responsibility for the duties of this contract, the hirer leaves a deposit of 700€ with a credit card. The refund will be effective after 48 hours of the vehicles return. Also this refund will be given after a positive mechanic’s managing inspection . The hirer will be responsible of all the damages experienced by the motorhome, no matter its origin. If the inspection is not satisfactory , the owner will hold the appropriate amount needed to fix the vehicle. We inform you that the loss of the vehicle’s keys will imply a cost of 125€ to be paid by the hirer which will be taken from the 700€ deposit counting that there is enough money left in case of having to pay more money due to damages already counted for.

5.- The hirer cannot:

a/ Destin the vehicle to other activities such as going against the morals , laws and good manners;

b/ Carry more people than permitted by law;

c/ Transport goods and objects;

d/ Give the vehicle to a third part under any circumstance;

e/ Use the vehicle for competition;

f/ Drive under the influence of alcohol , other substances , toxics, or, in any situation that may change the physical and mental state of the person driving;

g/ Push or pull any object or vehicle;

h/ Allow a third person to drive the vehicle, if this one does not comply with the requirements shown in the first part of this document.

6.- The hirer must:

a/ Always keep the vehicle’s documents and keys , not allowing to leave them inside the vehicle;

b/ Lock the vehicle at all times.

7.- The hirer is responsible for any traffic booking, regardless of its cause, as well as the restraint of the vehicle, and will have to pay for all the cost caused by any of the above.

8.- Any accident or incident must be informed to the owner as soon as possible.

9.- The owner will refund any repair due to the normal usage not exceeding 120€ when holding all the receipts. If the amount is superior or the repair made before are as much as the amount mentioned before, then the owner will have to give his consent. The hirer is responsible for the repairs he requires. Repairs due to floor damages or pavement are the hirer’s responsibility.

10.- Any petrol expenses will be the hirer’s responsibility.

11.- The hirer will proceed to carry out the necessary check outs, and will be the hirer’s responsibility. Any problem caused by the faulty execution of those check outs will be the hirer’s responsibility.

12.- Unless the hirer holds a special permit to allow him to do so, he would not be able to travel to: Iraq, old Yugoslavia, and Arabic countries.

13.- If the owner is not able to deliver the motorhome due to a dire necessity , he will have to refund all the money to the hirer given to the date.

14.- Insurance. Responds exactly to all the conditions for the hirer’s interest. In any case this means the delay of the existing responsibility between the hirer and the owner.

15.- If the collection and delivery of the vehicle is done by a third party this one will have to be the hirer’s representative.

16.- The parties will meet at Barcelona’s Tribunals.
